Terms & Conditions

These Terms and Conditions (the “Agreement”) are a legal contract between Agra Web Hosting (hereinafter referred to as “the Company,” “we,” “us,” or “our”) and the Client (hereinafter referred to as “you” or “your”).

By activating your account or using our services, you agree to be bound by the following terms.

1. Scope of Services

Agra Web Hosting Services provides web hosting, domain registration, and related technical support as per the specific plan purchased.

  • Resource Allocation: Each plan has specific limits for CPU, RAM, Disk Space, and Bandwidth. Exceeding these may result in temporary suspension or a requirement to upgrade.
  • Service Availability: We aim for a 99.9% uptime guarantee. This excludes scheduled maintenance (notified 24 hours in advance) and “Force Majeure” events (e.g., natural disasters, national fiber cuts).

2. Acceptable Use Policy (AUP)

You agree to use our services only for lawful purposes. You are strictly prohibited from hosting:

  • Illegal Content: Any material that violates Indian law, including the Information Technology Act, 2000.
  • Spamming: Sending unsolicited bulk emails or maintaining “open relays.”
  • Harmful Scripts: Software that disrupts our servers or other users (e.g., malware, mining bots, or DDoS scripts).
  • Adult Content: We do not allow the hosting of pornographic or sexually explicit material.

3. Payment and Billing

  • Invoicing: Services are billed in advance (Monthly, Quarterly, or Annually).
  • Late Payments: If an invoice remains unpaid 5 days after the due date, services will be suspended. Data will be permanently deleted 15 days after suspension if the account remains unsettled.
  • Refund Policy: We offer a 30-day money-back guarantee for new shared hosting accounts. Domain registrations and SSL certificates are non-refundable.

4. Data Security and Backups

  • Client Responsibility: You are solely responsible for maintaining your own local backups. While we may perform routine server backups, we do not guarantee data recovery in the event of a total failure or accidental deletion by the client.
  • Security Clearance: For high-security domains (e.g., .gov.in or .edu.in), clients must ensure their website has undergone a security audit by a CERT-In empanelled auditor.

5. Intellectual Property

  • Ownership: You retain full ownership of all content, data, and intellectual property uploaded to our servers.
  • License: You grant us a limited, non-exclusive license to host, store, and transmit your content solely for the purpose of providing the service.

6. Liability and Indemnification

  • Limitation of Liability: In no event shall Agra Web Hosting Services be liable for any loss of profit, data, or business interruption. Our total liability is limited to the amount paid by you for the service in the 12 months preceding the claim.
  • Indemnity: You agree to indemnify and hold us harmless from any claims, damages, or legal fees resulting from your use of the service or any breach of these terms.

7. Termination

  • By Client: You may terminate your service at any time via the billing portal.
  • By Company: We reserve the right to terminate services immediately and without notice if you violate our Acceptable Use Policy or engage in fraudulent activities.

8. Governing Law and Jurisdiction

These terms are governed by the laws of India. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts located in Agra, Uttar Pradesh.
